You agree to use this Site only for lawful purposes and in a manner that does not:

  • Infringe upon the rights of others, including intellectual property rights
  • Transmit any unsolicited or unauthorized advertising or promotional material

3. Intellectual Property

Work product created by Ascend Media on behalf of clients (ad creatives, copy, websites, etc.) is subject to the intellectual property terms outlined in the applicable client service agreement.

4. Client Responsibilities

Clients engaging Ascend Media for services agree to:

  • Provide accurate business information, access credentials, and materials necessary to perform services
  • Review and approve deliverables in a timely manner as outlined in the service agreement
  • Maintain ownership of and responsibility for all advertising accounts, platforms, and business assets
  • Pay all fees as outlined in the service agreement on time

5. Payment Terms

Payment terms, retainer amounts, setup fees, and billing cycles are specified in individual service agreements. Failure to remit payment by the due date may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.

6. Results Disclaimer

Results shown are based on the experiences of specific clients and are not guarantees, promises, or predictions of future outcomes. Individual results vary based on factors including market conditions, competition, implementation, client responsiveness, advertising platforms, and other circumstances. Ascend Media does not guarantee increases in clients, leads, revenue, income, search rankings, return on investment, or advertising performance.

This Site is not part of the Facebook website or Meta Platforms, Inc., and is not endorsed by Meta in any way. FACEBOOK and INSTAGRAM are trademarks of Meta Platforms, Inc. This Site is also not part of, or endorsed by, Google LLC.

Website suggestions, ad grades, marketing audits, blueprints, accounting-firm marketing collateral, and website or copy rewrite suggestions may be AI-assisted marketing analyses provided for informational purposes only. They are not a guarantee of advertising performance, client volume, lead volume, revenue, rankings, or return on investment.

7. Limitation of Liability

To the fullest extent permitted by law, Ascend Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including but not limited to loss of revenue, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you to Ascend Media in the three (3) months preceding the claim.

8. Termination

Either party may terminate a service engagement as outlined in the applicable service agreement. Ascend Media reserves the right to terminate or suspend access to the Site or services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the public.

9. Third-Party Tools and Platforms

Our services may involve the use of third-party platforms including GoHighLevel, Google Ads, Meta Ads, and others. Your use of these platforms is subject to their respective terms of service. Ascend Media is not responsible for changes to third-party platform policies, pricing, or availability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Escambia County, Florida.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of the Site or services after changes are posted constitutes your acceptance of the revised Terms.
